Entity Name Declaration
For the purposes of this document, “Lost Temple Games” and “MAXX Games” refer to the same legal entity. Any reference to either name shall be deemed a reference to that same entity, and the two names may be used interchangeably where the context requires.
The use of either name does not create a separate legal person or alter any rights, obligations, liabilities, or responsibilities under this document.
1. Service Provider Information

Service Name: MAXX Games, including its games, websites, mobile applications, software, accounts, and related features (collectively, the "Service").
2. Agreement Effectiveness and Legal Binding Force
By selecting an acceptance control, downloading or installing a game, launching the Service, accessing a feature, or continuing to use the Service, you represent that:
- You have the legal capacity to enter this Agreement, or your parent or legal guardian has provided the consent required for a minor.
- You have read, understood, and agreed to these Terms and Conditions (the "Agreement").
- Your use of the Service forms a legally binding agreement between you and the applicable MAXX service provider.
We may revise, update, or replace this Agreement. Unless mandatory law requires a different process, revised terms take effect 15 days after publication on our official website. Continued use after the effective date indicates acceptance of the updated Agreement.
3. Privacy Policy and Data Handling
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, retain, disclose, protect, and transfer personal information.
3.1 Data Collection and Use
We may process device identifiers, account credentials, gameplay activity, transaction information, support requests, and communications such as chat logs. We use this information to provide, maintain, improve, personalize, and secure the Service and to satisfy legal obligations.
3.2 Cross-Border Data Transfers
Personal information may be transferred to countries outside your place of residence. Where required, we rely on approved safeguards such as Standard Contractual Clauses (SCCs), Binding Corporate Rules (BCRs), or other recognized transfer mechanisms.
3.3 Special Categories of Data
We do not process biometric information, health information, or children's data—defined here as data relating to users under 16 or a lower threshold set by local law—unless an applicable legal basis and safeguards exist:
- For children's data, we obtain verifiable consent from a parent or guardian where COPPA, GDPR, or comparable law requires it.
- For biometric or health data, we obtain explicit, informed consent and limit processing to the disclosed purpose.
3.4 User Rights
Subject to applicable law, you may request access, correction, deletion, portability, or restriction of your personal information, or object to certain processing. Contact contact@losttemplegames.com or use the data deletion request form.
4. Age Restrictions and Guardian Obligations
4.1 Minimum Age Requirement
- Prohibited Users: Children under 13, or under 16 where that EU threshold applies, may not access or use the Service. Accounts identified as belonging to prohibited users may be suspended or terminated.
- Minor Users: Users aged 13–17, or 16–17 where the higher EU threshold applies, may use the Service only with verifiable consent from a parent or legal guardian.
4.2 Guardian Responsibilities
A guardian who permits a minor to use the Service must:
- Confirm that they have reviewed and understood this Agreement.
- Explain important provisions—such as data practices and the non-ownership of Virtual Items—in age-appropriate language.
- Monitor the minor's activity, including spending and communication, at least biweekly and use available parental controls.
- Accept responsibility, to the extent allowed by law, for breaches by the minor, including unauthorized transactions or intellectual-property violations.
5. User Obligations and Prohibited Conduct
You must use the Service lawfully and must not directly or indirectly engage in the conduct below.
5.1 Unauthorized Access or Interference
- Access or use the Service where doing so is illegal or restricted.
- Use VPNs, bots, automation, or other technical methods to evade geographic, account, security, access, or anti-cheat controls.
- Conduct DDoS attacks, distribute malware, exploit vulnerabilities, overload systems, or otherwise disrupt the Service.
5.2 Account Misuse
- Sell, lease, transfer, loan, rent, or otherwise provide an account or its Virtual Items to another person.
- Use an account for unsolicited advertising, affiliate marketing, or unauthorized commercial promotion.
- Create false or automated accounts or use stolen, misleading, or fraudulent identity information.
5.3 Violations of Law or Public Policy
- Use the Service for unlawful activity, gambling involving Virtual Items, hate speech, fraud, or copyright infringement.
- Upload or distribute illegal content, including child-exploitation material or content that incites violence.
- Harass, threaten, stalk, impersonate, or doxx another person, including by exposing private addresses or personal information.
5.4 Intellectual Property Infringement
- Reverse engineer, decompile, disassemble, modify, or attempt to extract source code or assets from the Service except where law expressly permits it.
- Use cheats, mods, scripts, unauthorized third-party software, or similar tools to manipulate gameplay.
- Copy, publish, distribute, sell, or commercially exploit game clients, artwork, music, or other Service content without written authorization.
5.5 Virtual Item Misuse
- Trade Virtual Items for fiat currency, cryptocurrency, real-world products, services, or anything else of value unless expressly authorized.
- Use Virtual Items in connection with illegal transactions, fraud, or money laundering.
6. Legal Status of Virtual Items
6.1 Definition
"Virtual Items" include virtual currency, coins, skins, boosts, loot boxes, and other non-physical digital content made accessible through the Service.
6.2 Non-Property Rights
You acknowledge that Virtual Items:
- Do not constitute personal property and do not grant ownership, title, equity, or another property interest.
- Are licensed rather than sold and may be used only within the Service and subject to this Agreement.
- May be changed, suspended, restricted, or removed without compensation where permitted by law.
6.3 Restrictions on Use
- No Real-World Trading: Virtual Items may not be exchanged for money, cryptocurrency, products, services, or other real-world value.
- No Transfer: Virtual Items may not be sold, gifted, inherited, rented, or transferred between users unless the Service expressly provides that feature.
- Termination Effect: Unused Virtual Items may expire or become inaccessible immediately when an account is suspended or terminated or when the relevant Service ends, subject to mandatory law.
7. Intellectual Property
MAXX and its licensors retain all rights, title, and interest in the Service, including its software, trademarks, trade names, logos, characters, artwork, text, music, audiovisual material, gameplay elements, and other content. Access to the Service or Virtual Items does not transfer any copyright, trademark, patent, or other intellectual-property right to you.
8. Payment and Refunds
8.1 Transactions
Purchases completed through an app store, payment card, or in-game payment system are generally final and non-refundable, except:
- Where a refund is required under mandatory consumer-protection law, including applicable rights under EU Directive 2011/83/EU or local consumer law.
- Where we or the relevant payment provider determine that a transaction was fraudulent, duplicated, technically erroneous, or otherwise eligible for correction.
App Store and Google Play purchases may also be subject to the platform's payment and refund rules.
8.2 Account Security
You are responsible for protecting account credentials and for activity conducted through your account. Report suspected unauthorized access or charges within 72 hours after discovery. Where available, use two-factor authentication (2FA) and other security controls.
9. Dispute Resolution
9.1 Mandatory Pre-Arbitration
Before filing a formal claim, contact contact@losttemplegames.com and provide enough information for us to understand and attempt to resolve the dispute. We aim to respond within 14 business days.
9.2 Arbitration
If informal resolution is unsuccessful and arbitration is valid and enforceable in your jurisdiction, a dispute may be submitted to binding arbitration under the institution, seat, and procedural rules identified by the responsible MAXX legal entity or otherwise required by applicable law.
- Language: English, unless applicable law or the agreed arbitration rules require otherwise.
- Evidence: Documents and hearings may be handled electronically or by video conference where the rules allow.
- Class Actions: To the extent permitted by law, disputes must be brought individually rather than as a class, collective, consolidated, or representative action.
10. Liability Limitation
To the fullest extent permitted by applicable law:
- General Liability: MAXX is not responsible for indirect, incidental, special, punitive, or consequential loss, including loss of profit, opportunity, goodwill, or data, arising from use of the Service.
- EU Users: Where liability for a material breach cannot be excluded, responsibility is limited to direct losses that were reasonably foreseeable.
- Global Exclusions: We are not responsible for delays or failures caused by events beyond reasonable control, including natural disasters, government action, internet or utility failures, labor disputes, and third-party platform or service outages.
Nothing in this Agreement excludes or limits liability that cannot legally be excluded or limited.
11. Miscellaneous
- Governing Law: This Agreement is governed by the law applicable to the MAXX legal entity providing the Service, without regard to conflict-of-law rules, while preserving any mandatory consumer rights in your country.
- Entire Agreement: This Agreement, the Privacy Policy, and any additional rules expressly incorporated into them form the complete agreement concerning your use of the Service and replace prior representations or understandings on the same subject.
- Severability: If a provision is found invalid or unenforceable, it will be adjusted or removed only to the necessary extent, and the remaining provisions will continue in effect.
- No Waiver: A failure to enforce a provision does not waive the right to enforce it later.
- Assignment: You may not transfer this Agreement without our consent. We may transfer it as part of a merger, reorganization, financing, asset transfer, or similar business event where permitted by law.

By accessing or using the Service, you confirm that you accept this Agreement. Continued use after a valid revision takes effect constitutes acceptance of the revised terms, subject to mandatory local law.
